For the purposes of these Terms:
Repatrack PRO is a technology marketplace platform that facilitates contact between Customers and Carriers through digital means, including publishing requests, sending and receiving offers, communication between users, data visualisation, management of transport requests and related features.
Repatrack PRO does not directly provide roadside assistance, transport services, repatriation, logistics services or brokerage transport services within the meaning of applicable legislation, and does not act as a carrier, subcontractor, freight forwarder, commercial agent, commissioner, insurer, payment institution or escrow holder for transactions between a Customer and a Carrier.
The Operator provides only technological infrastructure and does not become a party to any contract, arrangement, negotiation, offer, confirmation, payment, performance or dispute between a Customer and a Carrier.
Any contract for a specific service arises solely between the Customer and the relevant Carrier. Repatrack PRO is not liable for the content, validity, legality, performance or non-performance of such a contract.
The Repatrack PRO platform is managed by:
Kaloyan KanchevReferred to below as the "Operator".
The platform may only be used by persons who have the legal capacity to enter into binding legal relationships under applicable law.
Where a User acts on behalf of a legal entity, they represent that they have the necessary authority to bind that legal entity to these Terms.
The Operator may at any time request additional information to verify identity, authority or eligibility to use the platform.
Certain features of the platform require registration and the creation of an account.
Upon registration, the User may provide data such as:
The User is fully responsible for:
The User must immediately notify the Operator upon suspicion of unauthorised access, abuse or a security breach affecting their account.
The Operator may at its sole discretion, and without prior notice, restrict, freeze, suspend or terminate access to an account where there is suspicion of a legal violation, breach of these Terms, abuse, fraud, circumvention of platform rules, risk to other users, reputational risk or technical/security reasons.
When publishing a request, the Customer undertakes to provide accurate, truthful, current and sufficient information, including where applicable regarding:
The Customer bears full responsibility for incomplete, false, misleading or inaccurate information, including where it leads to impossibility of performance, delays, additional costs, damages or a dispute with the Carrier.
Accepting an offer through the platform constitutes an agreement between the Customer and the relevant Carrier regarding the terms proposed by them. Repatrack PRO does not participate in the negotiation, does not set the price, does not guarantee performance and is not liable for any aspect of the specific service.
The Customer selects a Carrier entirely at their own discretion and risk.
Where a Customer receives multiple offers for their listing but takes no action — neither rejecting nor accepting any offer — and at least one offer is priced within 1% to 20% of the Customer's stated amount, the administrator may, at their discretion, cancel the listing. In such case the listing is returned to the garage and cannot be republished for a period of 30 days.
Carriers bear full and independent responsibility for:
The Carrier must provide services under the conditions stated in their offer, unless otherwise agreed directly with the Customer.
Profile verification. The platform may offer a verification feature or additional identity data completion. Such verification has solely an internal, organisational and informational character for the purposes of platform operation and access to certain features.
Verification does not constitute licensing, certification, legal analysis, regulatory audit, compliance check, due diligence, background check, criminal record check, professional qualification check, ownership verification, insurance validity check, registration regimes, permits or other statutory requirements.
Registration and approval of platforms (vehicles). When registering a vehicle or platform, the Carrier may be required to upload photos, a registration number and other data. Administrator approval has only a technical and visual character, including an assessment of whether the required files have been uploaded, whether the registration number is visible and whether the record can be activated in the system.
Such approval does not constitute and must not be interpreted as confirmation, guarantee or certification by the Operator regarding:
The status "company", "private individual", "verified" or any similar status on the platform is based entirely or predominantly on data provided by the Carrier, unless expressly stated otherwise. The Operator does not guarantee the accuracy of such a status.
Where a Carrier provides false, incomplete or misleading information they bear full responsibility for all direct and indirect consequences, including damages, claims, penalties, fines, costs and disputes.
Customers are not charged a fee for using the platform, unless they opt for a paid subscription or additional feature where such is available.
Carriers and/or other users may pay subscription fees for access to certain features, plans, benefits or tools on the platform.
Subscription payments may be processed by external payment service providers, including Stripe and Now Payments, subject to the terms and conditions of the respective external provider.
Repatrack PRO does not store card data and does not act as a payment institution, payment instrument issuer, funds custodian or escrow provider, unless expressly stated otherwise in separate terms.
Where applicable, the amount payable in cryptocurrency is determined by the exchange rate applicable at the time of processing the relevant payment by the external payment provider.
Payments for the actual transport or repatriation service are made directly between the Customer and the Carrier, unless expressly stated otherwise in separate terms for a specific feature. The Operator is not a party to such payments and is not liable for their execution, basis, amount, validity, refund, dispute or consequences.
Unless expressly provided otherwise by law or in separate special terms, paid subscription fees and fees for activated features are non-refundable for periods already provided or services already activated.
The platform may allow users to publish ratings, reviews, descriptions, photos, messages, comments and other content.
The User bears sole responsibility for content they publish and declares that it:
The Operator has the right, but not the obligation, to monitor, restrict, moderate, edit, hide or remove content at its own discretion where it violates the law, these Terms, third-party rights, platform security or its reputation.
By publishing content the User grants the Operator a non-exclusive, royalty-free, territorially unlimited right to use, store, reproduce, display and process the content solely insofar as necessary for the operation, security, maintenance, promotion and improvement of the platform.
Users may not use the platform for or in connection with:
In the event of a violation, the Operator has the right to act without notice, including restricting features, deactivating content, temporary suspension, permanent account termination and/or cooperation with competent authorities.
The platform is provided "as is" and "as available".
To the maximum extent permitted by applicable law, the Operator gives no and excludes all express, implied, statutory or other warranties, including but not limited to:
To the maximum extent permitted by applicable law, Repatrack PRO and the Operator are not liable for:
All claims relating to the performance or non-performance of a transport or repatriation service must be directed to the relevant Carrier or Customer, as the case may be.
To the extent permitted by law, the Operator's total liability to any User, regardless of the basis of the claim, shall not exceed the greater of: (a) the amount paid by that User to Repatrack PRO during the preceding 12 months, or (b) EUR 50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.
The Operator has no obligation to participate in negotiations, mediation, arbitration, debt collection, dispute resolution, payment reversal or enforcement between Users.
The Operator may at its own discretion, without being obliged, provide limited administrative assistance through restricted communication or technical information, but this does not make it a party to the dispute or create liability for its outcome.
The Operator does not guarantee that the platform will always be available, uninterrupted, error-free or free from vulnerabilities.
The Operator reserves the right at any time to amend, temporarily suspend, restrict or discontinue some or all platform features, including for the purposes of:
The Operator is not liable for non-performance or delay caused by circumstances beyond its reasonable control, including but not limited to: force majeure, natural disasters, failures, power or internet outages, cyberattacks, acts of public authorities, war, civil unrest, epidemics, strikes, issues with service or payment providers.
Unless expressly stated otherwise, all rights in the platform, including its structure, design, code, features, trade names, texts, graphics, logos and other elements, belong to the Operator or the respective rights holders.
Nothing in these Terms grants the User the right to copy, modify, distribute, licence, sell, republish, extract or commercially exploit any part of the platform without prior written consent, except to the extent necessary for its ordinary use as intended.
The Operator may restrict, suspend or terminate access to the platform or to individual features in the event of:
The User may cease using the platform at any time, without affecting obligations, liabilities or rights already arising, or the Operator's right to retain data where required or permitted by law.
The processing of personal data is carried out in accordance with applicable legislation and the Privacy Policy and Cookie Policy of Repatrack PRO.
Users may not publish or provide through the platform personal data of third parties without a valid legal basis. Any unlawful disclosure, sharing or processing of personal data between users is the responsibility of the relevant user.
Nothing in these Terms is intended to or should be construed as excluding, limiting or derogating from rights the User holds under mandatory provisions of applicable law.
If any particular clause is found to be unenforceable against a user by virtue of a mandatory statutory rule, this shall not affect the validity of the remaining clauses.
The User agrees to indemnify and hold harmless the Operator, as well as its suppliers, partners, contractors and persons acting on its behalf, from and against any claims, actions, proceedings, damages, losses, penalties, costs and liabilities, including reasonable legal fees, arising from or related to:
All rights in the Repatrack PRO platform, including but not limited to software, code, design, interface, database, features, texts, graphics, logos and trademarks, belong to the Operator or the respective licensors.
Users receive a limited, non-exclusive, non-transferable and revocable right to use the platform solely for the purposes for which it is intended, in accordance with these Terms.
The following are not permitted:
Content published by users remains their property, but by uploading it they grant Repatrack PRO a non-exclusive right to use it for the purposes of operating and promoting the platform.
The Operator reserves the right to amend, supplement and update these Terms at any time.
Amendments take effect from the moment of publication on the website, unless expressly stated otherwise.
Where appropriate, the Operator may also notify Users via the platform interface, by email or through other suitable means, but the absence of individual notification does not render changes inapplicable where they have been duly published.
Continued use of the platform after publication of the amendments constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria.
All disputes that cannot be resolved amicably shall be referred to the competent court in the Republic of Bulgaria, unless applicable mandatory legislation provides otherwise, including in respect of consumers.
If any provision of these Terms is found to be void, invalid, unenforceable or inapplicable, this shall not affect the validity of the remaining provisions, which shall continue to operate to the maximum extent permitted by law.
The failure or delay by the Operator to exercise any right does not constitute a waiver of that right.
All amounts, values and figures displayed on the platform, including but not limited to offer values, costs, estimated results, margins and similar data, are purely indicative.
These values are displayed on the basis of data entered by users and/or accepted offers and related records on the platform.
The platform does not participate in payments between parties, does not carry out accounting on their behalf and does not guarantee the accuracy, completeness or actual fulfilment of stated values.
All financial arrangements, payments, agreements and their consequences are conducted directly between the relevant users and remain entirely outside the control and liability of the platform.

Where the request is intended only for the Dispatcher, this data is provided solely to them and is not disclosed to other Carriers through the platform, unless the Dispatcher expressly publishes or forwards the request to the platform or to a specific Carrier.

Once published to the platform, the request may cease to be exclusive to the Dispatcher and offers or communication from other Carriers may be received.

The platform provides technological infrastructure for submitting, managing and communicating on requests, but does not guarantee carrier availability, price, timeframe or performance.
Transactions and payments. All transactions, payments, arrangements and agreements relating to requests for roadside assistance, transport, repatriation or other services are concluded directly and exclusively between the respective parties, including Customer — Carrier, Dispatcher — Customer or Dispatcher — Carrier, entirely outside the platform, unless expressly stated otherwise.
